🃏 Poker Coach — Terms of Service

These Terms of Service ("Terms") govern your use of the Poker Coach mobile application ("the App") operated by Shoresh Khezri ("we", "us", "the Developer"), located in Norway. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Nature of the App

Poker Coach is a poker education and training tool. No real money is involved. No gambling occurs. No wagering of any kind takes place.

This App is designed solely for educational purposes — to help users learn and practice poker strategy in a risk-free environment.
You play against AI-controlled opponents (bots) only. There is no multiplayer or user-versus-user gameplay.
Virtual chips in the App have no real-world monetary value and cannot be exchanged, withdrawn, or converted to real currency.
The App is not connected to any real poker site, casino, or gambling platform.
This App must not be used as a tool for real-money gambling. The strategies, coaching, and analysis provided are for learning purposes only and should not be relied upon as a basis for wagering real money.
The Developer does not encourage, promote, or facilitate real-money gambling in any form.
The App is intended for users aged 18 and older.

2. AI Coaching Disclaimer

The AI coaching provided in this App is for educational and entertainment purposes only.

Coaching content is generated by artificial intelligence (including OpenAI GPT models) and may contain inaccuracies, errors, or hallucinations. AI-generated text is not guaranteed to be correct, complete, or reliable.
The coaching does not constitute professional advice of any kind — including but not limited to financial, gambling, legal, or investment advice.
We do not guarantee that following the coaching suggestions will improve your poker performance, win rate, or results in any real-world poker game.
You are solely responsible for your own decisions at any real poker table. The Developer is not liable for any financial losses, gambling losses, or other damages resulting from reliance on the App's coaching output.
Equity calculations, pot odds, and strategy recommendations are approximations based on Monte Carlo simulations and heuristic rules — they are not exact mathematical guarantees.

3. Account & Credentials

You are responsible for maintaining the confidentiality of your account credentials (email/password).
Do not share your login credentials with any other person.
You are responsible for all activity that occurs under your account.
If you suspect unauthorized access, change your password immediately and contact us.
We reserve the right to suspend or terminate accounts that are shared, abused, or used in violation of these Terms.
Each person should maintain their own individual account. Account sharing is not permitted.

4. Subscriptions & Billing

The App offers a 30-day free trial from the date of first registration. During the trial, you may play up to 5 hands per day with deterministic coaching included. After the trial period, a subscription is required to continue using the App.
Basic ($4.99/month) — Unlimited gameplay with deterministic coaching.
Premium ($12.99/month) — Unlimited gameplay with GPT-powered AI coaching.
Subscriptions are auto-renewable and billed monthly through Apple App Store or Google Play Store.
Payment is charged to your iTunes Account or Google Play account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription at any time through your device's account settings (Apple: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions).
Refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
Prices may change. We will notify you in advance of any price change, and you may cancel before the new price takes effect.

5. Acceptable Use

You agree NOT to:

Use the App for any illegal purpose or in violation of any local, national, or international law
Attempt to reverse-engineer, decompile, or extract the source code of the App
Attempt to circumvent rate limits, usage restrictions, or subscription tier enforcement (including reinstalling the App to reset trial periods)
Use automated scripts, bots, or tools to interact with the App or its backend API
Attempt to access other users' accounts, data, or sessions
Abuse, flood, or overload the App's servers or API endpoints
Share, redistribute, or resell access to the App or its coaching output in any commercial context
Use the App's coaching output to create competing products or services
Misrepresent yourself or impersonate another person when creating an account

6. Intellectual Property

The App, including its design, code, 8-agent AI pipeline, coaching system, and all associated content, is the intellectual property of the Developer.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
AI-generated coaching text is provided for your personal use only. You may not republish, redistribute, or commercialize bulk coaching output.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of bugs, viruses, or harmful components.
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
- Financial losses from applying AI coaching suggestions in real poker games
- Loss of data or account access
- Service interruptions or server downtime
- Inaccurate AI-generated coaching content
Our total liability to you for any claim arising from or related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any applicable law
Any third-party claims related to your use of the App

9. Bugs & Software Quality

The App may contain bugs, errors, or unexpected behavior. We do not guarantee that the App is free of defects.
The 30-day free trial period is provided so you can evaluate the App and determine if it meets your needs before subscribing. By subscribing after the trial, you acknowledge that you have tested the App and accept its current state.
We may release updates to fix bugs, but we are under no obligation to fix any specific bug or to do so within any particular timeframe.
If you encounter a bug, you may report it to our support email. We appreciate bug reports but cannot guarantee a fix or response time.

10. Service Availability & Modifications

We may modify, suspend, or discontinue the App or any feature at any time without prior notice.
We do not guarantee that the App will be available indefinitely. If we permanently discontinue the App while you have an active paid subscription, we will provide a prorated refund for the unused portion of your current billing period. Refunds will be processed through Apple or Google according to their respective refund procedures.
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
The App requires an internet connection to function. We are not responsible for connectivity issues on your end.
Game sessions are stored temporarily on the server. If the server restarts, your current hand in progress may be lost. This is expected behavior.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice.
You may stop using the App at any time and cancel your subscription through your device's account settings.
Upon termination, your right to use the App ceases immediately. Sections on liability, indemnification, and intellectual property survive termination.

12. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which describes what data we collect and how we use it.

13. Governing Law & Disputes

These Terms are governed by the laws of Norway.
Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Norway.
For EU consumers: you may also be entitled to use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
